الشروط والأحكام – Tab Card

1. التوافر والتسعير

نقوم في Tab Card ببيع العديد من البطاقات والهدايا الرقميّة ("البطاقات الرقمية") عبر خدماتنا المختلفة.

جميع البطاقات الرقمية خاضعة للتوافر، ونحتفظ بالحق في تقييد أو رفض أي طلب أو جميع الطلبات، كما نحتفظ بالحق في إيقاف بيع أي بطاقة دون إشعار سابق—even إذا قمت بوضع طلب مسبق.

الأسعار قابلة للتغيير دون إشعار، وسيتم احتساب السعر المعروض على الموقع وقت إتمام طلبك.

2. شروط المورّدين والمسؤولية

البطاقات الرقمية التي تشتريها من خلال خدماتنا يتم إصدارها وتفعيلها عبر مزودي خدمات ومتاجر خارجية. يخضع شراء كل بطاقة لشروط وأحكام يحددها المورّد بالإضافة إلى هذه الشروط.

• قد يحدد المورّدون تواريخ انتهاء صلاحية للبطاقات، بالإضافة إلى أي قيود أو شروط تختلف حسب قوانين بلدك أو طبيعة البطاقة.
• من المهم مراجعة شروط وأحكام المورّد قبل شراء أي بطاقة رقمية. إذا كان لديك أي استفسار يمكنك التواصل مع المورّد نفسه.
• بما أن المورّدين هم المُصدرون للبطاقات، فإنهم (وليس Tab Card) المسؤولون عن جميع جوانب البرامج الخاصة بهم.
• المورّدون مسؤولون كذلك عن أي تكاليف أو مسؤوليات (يُشار إليها بـ"المسؤوليات") قد يتعرض لها العميل نتيجة لخدماتهم أو منتجاتهم بشكل مباشر أو غير مباشر.

على الرغم من أن Tab Card تتعامل مع مورّدين موثوقين، إلا أننا غير مسؤولين عن أي تعامل بينك وبين المورّد أو عن عدم قبول المورّد للبطاقة، وستحتاج للتواصل مع المورّد مباشرة لحل أي مشكلة من هذا النوع.

أنت توافق على إبراء ذمّة Tab Card من أي مسؤوليات ناتجة عن أي فعل أو تقصير من المورّد.

كما أن Tab Card والمورّدين غير مسؤولين عن البطاقات المفقودة أو المسروقة.

3. خيارات الدفع

يقبل Tab Card طرق الدفع التالية:

• مدى
• فيزا
• ماستركارد
• أبل باي – Apple Pay
• تابي – Tabby
• بالإضافة إلى وسائل الدفع الرقمية المتاحة عند checkout.

ما لم يُذكر غير ذلك، يتم دفع قيمة البطاقة الرقمية بالكامل عند قيام Tab Card بتسليمها لك.

عند تقديم طلبك، فأنت تؤكد أنك مخوّل باستخدام وسيلة الدفع، وتسمح لنا بخصم قيمة الطلب من البطاقة أو الوسيلة التي اخترتها.

في حال تعذّر التحقق من وسيلة الدفع أو كانت غير صالحة، قد يتم تعليق طلبك أو إلغاؤه تلقائيًا.

قد تُفرض رسوم معالجة على بعض وسائل الدفع حتى لو كانت البطاقة منتهية أو تغيّرت قبل إرسال العملية.

أنت مسؤول عن حل أي مشكلة تتعلق بوسيلة الدفع لاستكمال طلبك.

4. الضرائب

المبالغ المدفوعة مقابل البطاقات الرقمية لا تشمل الضرائب المفروضة (إن وجدت).

قد يقوم المورّد بفرض ضرائب إضافية عند استخدامك للبطاقة لديهم حسب قوانين المنطقة.

5. تفعيل البطاقات الرقمية

بعد شراء البطاقة، يجب عليك (أو الشخص المرسل إليه) تفعيل البطاقة عبر التعليمات المرفقة.

لن تعمل البطاقة إلا بعد إتمام التفعيل.

6. الإلغاءات وعدم وجود إرجاع

جميع الطلبات نهائية.

البطاقات الرقمية غير قابلة للإرجاع أو الاسترداد أو الإلغاء بعد تسليمها.

ومع ذلك:

إذا كانت البطاقة لا تعمل، فقد نقوم—وفقًا لتقديرنا—بإعادة المبلغ أو استبدال البطاقة بأخرى من نفس المورّد أو بمنتج مماثل بنفس القيمة.

7. الأخطاء

نسعى لتقديم معلومات دقيقة قدر الإمكان، ولكن لا نضمن خلو الموقع أو وصف المنتجات من الأخطاء.

في حال وجود خطأ بالسعر أو المعلومات أو أثناء معالجة الطلب، نحتفظ بالحق في:

• تصحيح الخطأ وإعادة تعديل طلبك (بما في ذلك السعر الصحيح)، أو
• إلغاء الطلب واسترجاع المبلغ بالكامل.

8. المستخدمون والمناطق المحظورة

لا يُسمح لك باستخدام خدمات Tab Card إذا كنت:

• في دولة تخضع لعقوبات دولية تمنع التعاملات،
• مصنّفًا ضمن قوائم الحظر الدولية،
• أو مدرجًا ضمن أي قائمة منع ذات صلة بالتجارة الدولية.

(هذا البند يُترك كما هو لاحتمالية تعامل مزوّدي البطاقات بهذه القيود.)

9. إخلاء المسؤولية

Tab Card غير مسؤول عن:

1. فقدان أو سرقة أي بطاقة رقمية بعد تسليمها،
2. أي خطأ أو تقصير من المورّد عند استخدام البطاقة.

يُسمح باستخدام البطاقات الرقمية فقط في المنصات المخصّصة لها.

لا يجوز استخدام البطاقات الرقمية كوسيلة دفع للقروض أو الضرائب أو شراء السلع المادية أو أي استخدام غير مخصص لها.

إخلاء المسؤولية:

الأعمال والشركات المذكورة غير مرتبطة أو راعية لمتجر Tab Card.

الشعارات والعلامات التجارية الخاصة بكل شركة هي ملك لتلك الشركة و/أو الشركات التابعة لها.

Terms & Conditions – Tab Card

1. Availability and Pricing

We sell numerous gift cards and gift codes ("Gift Cards") for purchase through our various services.

All Gift Cards are subject to availability and we reserve the right to limit or reject any or all orders and to discontinue gift cards without notice, even if you have already placed an order.

Prices are subject to change without notice and you will be charged the price set forth on the website at the time you place your order.

2. Vendor Terms and Liability

The Gift Cards that you purchase through our collective services are issued and activated by participating third-party retailers and vendors. The purchase of each Gift Card is governed by certain terms and conditions established by the issuing vendor in addition to these Terms:

• Vendors may set expiration dates for such Gift Cards, in addition to other restrictions and requirements depending on the applicable law of your jurisdiction and the promotional nature of certain Gift Cards.
• It is important that you review and familiarize yourself with all applicable Vendor terms and conditions prior to purchasing any Gift Card. If you have questions regarding the applicable Vendor terms, please contact the issuing Vendor.
• As issuers of the Gift Cards, Vendors (and not Tab Card) are fully responsible for all aspects of their Gift Card programs.
• Vendors are also responsible for any and all liabilities and costs (“Liabilities”) suffered by you or any other customer caused, directly or indirectly, by such Vendors or their products or services.
• While Tab Card strives to work with reputable Vendors, Tab Card has no liability for the sale of products or services to you by a Vendor through the use of any Gift Card or for any Vendor’s failure to honor a Gift Card, and you will need to look solely to such Vendor for any remedy in connection with the foregoing.
• You waive and release Tab Card and its subsidiaries, affiliates, partners, officers, directors, employees and agents from any Liabilities arising from or related to any act or omission of a Vendor in connection with a Gift Card it provides.
• Further, neither Tab Card nor any Vendor is responsible for lost or stolen Gift Cards.

3. Payment Options

Tab Card accepts various forms of payment including: Credit Card, Debit Card, and Tabby.

Unless otherwise indicated, the purchase price of Gift Cards will be billed in full at the time Tab Card provides the Gift Card to you.

By submitting your order, you acknowledge that you are authorized to use the designated card or other payment method and you authorize us to charge your purchase order to that card or payment method.

When you provide your payment information, you authorize us (or a third-party payment processor) to process and store your payment and related information.

In the event that the card or other payment method you designate cannot be verified, is invalid or is not otherwise acceptable, we may suspend or cancel your order automatically.

Card processing fees may apply even if the card has expired or changed by the time Tab Card submits the charges.

You are responsible for resolving any problem we encounter in order to proceed with your order.

All chargebacks and claims are subject to a $20.00 fee for cases that are not found in the customer’s favor.

4. Taxes

The amount paid for any purchasable Gift Card on the Services does not include sales, value-added, or use taxes, which may be charged to you separately by the applicable Vendor at the time you purchase products or services from the Vendor using the Gift Card.

5. Gift Card Activation

After purchasing a Gift Card, you (or the recipient of the Gift Card) must activate the Gift Card by following the instructions provided.

The Gift Card will only function upon such activation. Activated Gift Cards will be available within 30 seconds.

6. Cancellations; No Returns

All purchases made through the Services are final.

Purchased Gift Cards are non-returnable and non-refundable; provided, however, that if a Gift Card does not function, we may, in our sole discretion, either refund you the Gift Card purchase amount or replace the defective Gift Card with an alternative Gift Card or with products or services of equal value for the same Gift Card Vendor.

7. Errors

We attempt to be as accurate as possible and to eliminate errors on the Services; however, we do not represent or warrant that any description, Gift Card or Vendor or pricing information provided on our Services is accurate, complete, reliable, current or error-free.

In the event of an error, whether on our Services, in an order confirmation, in processing a Gift Card purchase or otherwise, we reserve the right to correct such error and revise your order accordingly (including charging the correct price) or to cancel the order and refund any amount charged.

8. Excluded Users and Territories

You are not permitted to make purchases from Tab Card if you are:

(a) located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services,

(b) identified as a “Specially Designated National,” or

(c) placed on the U.S. Department of Commerce’s Denied Persons List or Entity List or any other U.S. export control list.

9. Disclaimers

Tab Card is not responsible for any liabilities, damages, and costs arising from or related to:

(i) your loss or the theft of any Gift Cards; and

(ii) any act or omission of a Gift Card Vendor in connection with Gift Cards.

Gift Cards are ONLY allowed to be used on their respective marketplaces. Gift cards cannot be used as tender such as loans, mortgages, physical goods, IRS payments, etc.

We do not allow purchases of our gift cards for anything besides their intended use.
